Articles of Agreement

 

 

Articles of copartnership entered into between John McAninch and Henderson Dishough ...

John McAninch and Henderson Dishough

[pg.365] having purchased equally and jointly of John Amis and A. G. Underwood a steam

sawmill and agreed to own the same to the equal advantage of each and both of us do hereby

further agree that said mill is to be put in operation and a grist mill added to the same if [we do?]

prosper and both continued in operation so long as we may agree each one paying an equal

proportion of the expenses incident to putting and continuing the same in operation and at the

end of each and every year from this time to share equally and alike in the profits if any a

distribution of said profits to take place yearly and at no other time It is hereby expressly

further understood and agreed that neither of us is to take anything from said copartnership

only annually as aforesaid except to defray the expenses of the said mill as aforesaid unless

by mutual consent it should be hereafter otherwise agreed

It is further agreed that said Henderson Dishough is to Superintend the operation of said mill

or mills and to receive as a compensation therefore annually five hundred dollars from said

joint partnership and said Dishough hereby binds himself [properly?] to attend to and

Superintend the operation of said mill or mills, any time lost by said Dishough to be deducted

from said sum proportionally

Personally appeared before me Edward D. Jones Clerk of the County Court of Giles County

the within named Henderson Dishough and John McAninch with whom I am personally

acquainted and who acknowledged that they executed the within covenant or agreement for

the purposes therein contained

Witness my hand at office this 29th day of March A.D. 1840
